It has little to do with what is legal and much to do with what is considered normal and acceptable. |
Most likely these dynamics are a function of humans, multiplied against risk loving demographics. Ratio’ed by number of human interactions, Meaning that at any sufficient scale or volume, BJJ affiliations (or churches or whatever branded institution with cult-y trappings like “rank” large enough), Will have male and female predators, and predations occurring. Absence of reported issues, is in that way suspicious in any affiliation beyond a certain size. In that case, look for data gaps, cover ups, societal bias cover, and camouflage. “Toxic cultures” may be a base case, not an outlier. And the expected reversion case outside of daylight, and very strict, consistent, controls. It may be, that Jiu-Jitsu is more dangerous, Than beneficial for survivors of abuse, Or those vulnerable to it, Contrary to what our wishes were or are. Every one will claim and prefer to believe, their favorites, their conveniences, and their conflicts of interest, are the exception. But, probably not. Some people and groups will also attempt to monetize programs to address these problems, as a salable product, but those groups will be just as vulnerable as a program, as any other program, ironically. Caveat emptor, defend yourself at all times, and put rigorous controls in place. |
To be explicit: After thinking about this, objectively, Jiu-Jitsu is NOT an activity that I would recommend to survivors of sexual abuse. As this is a knucklehead sport, full of knuckleheads. I might recommend activities without cult trappings (such as the social belt “ranks") and, with less violence and less rape. Where I live, people may have and carry force multipliers, and basic fitness, goes a long way, for self-defense. I am not saying, that basic hand to hand training for such folks is not potentially useful, But, no cult trappings, no rank, none of that bullcrap, and only what they need, With a lot of daylight, strict and consistent controls, and transparencies, in place. |

Marital rape was made illegal in all parts of the United States by 1993. However, some States treat martial rape differently than other forms of rape regarding evidentiary requirements, penalties, etc. And, there are States which have, or did have, an exception to the statutory rape ages, if the two people were married, For instance, in those States, it may be Statutory rape to have sex with a 17 year old in a given State - unless the two people are married, and in some cases with the parent's permission to get married, as a hypothetical exception to Statutory rape provisions, related to spouses, in those States that have or had those variances.
